On April 26th, the Court of Appeal declared that number forecast totalisator, commonly known as NFT, is not considered a lottery. Instead, it is a controlled type of gambling.
A spokesperson from Superole Sdn Bhd announced yesterday that the appellate court made a significant decision on April 14, 2023. In this judgment, three Telelink agents were held responsible and Superole Sdn Bhd was granted the amount of RM1.2 million. This occurrence is being referred to as a landmark case.
According to the spokesperson, the appeals court reaffirmed that the Racing (Totalisator Board) Act 1961 regulates NFT.
Telelink has been conducting business in Sarawak since November 15, 2002 and the recent court ruling has validated its lawfulness and credibility.
The issue at hand was that three employees of Telelink had declined to surrender the funds obtained from sales of 1+3D (more commonly referred to as Da Ma Cai) at Telelink branches.
According to the spokesperson, the trio of representatives declined to give the money citing the prior statement of a particular retired housing and local government minister who had repeatedly declared in various newspapers that Telelink was not legitimate and that the company had neglected to secure the necessary license to establish Telelink branches in Sarawak.
He stated that on September 15th, 2011, Superole reached an agreement with the local authorities through a Consent Order to resolve their disagreements concerning the licensing of the Telelink outlets.
The latest court ruling has put an end to any further arguments about the law. People who work as agents and have been facing financial struggles since 2008, when the media first brought up the issue of illegality, can now breathe a sigh of relief.
He commented that this ruling is a major triumph for NFT operators throughout the nation, as it establishes that NFT qualifies as a lawful type of betting and necessitates regulation under the Racing (Totalisator Board) Act 1961.
He stated that this verdict will undoubtedly encourage more individuals to join the NFT sector, and will lead to increased creativity and expansion in the industry.
He also mentioned that Superole is determined to offer its customers secure and equitable NFT gaming opportunities, and is optimistic about the industry's prospects.
The attorneys Datuk Azrin Ahmat and Lai Kwong Hui from Suhaili and Bong Advocates stood for Superole, and lawyer Colin Lai represented the three agents. This information was reported by the Borneo Post.
